Tax Forms

The two other forms mentioned on our Tax Basics page are Form 8938 and the FBAR/FINCen Form 114 which are required for Americans and green card holders who have foreign bank accounts to file.

 

Form 8938 - Statement of Specified Foreign Financial Assets

For form 8938 see FAWCO’s 8938 Guidelines for a simple description and chart showing thresholds of foreign financial assets. This form is filed with your tax return and sent to the IRS.

Some good news! For Form 8938 there are higher filing threshold limits for those living outside the US (between $200,000 and $600,000 depending on filing status vs. $50,000.)

Use this form to report your specified foreign financial assets if the total value of all the specified foreign financial assets in which you have an interest is more than the  reporting threshold.


FBAR on FINCEN Form 114 – Report of Foreign Bank and Financial Accounts (FBAR) on Financial Crimes Enforcement Network (FinCEN) Form 114

Beginning 2014, FBARs have a new name! Now called FINCen 114 which must be efiled as of 2014.     .

Monday - Friday, 8 am to 4:30 pm Eastern Time US.

The FinCEN Form 114 is due April 15 following the calendar year reported. You are allowed an automatic extension to October 15 if you fail to meet the FinCEN annual due date of April 15. You don’t need to request an extension to file the FinCEN. No extensions are granted after October 15. Filing late or not at all is a violation and you may be subject to penalties.
