The Department of State (DoS) will, as of January 24, 2020, implement a new regulation (See https://federalregister.gov/d/2020-01218) that will restrict the issuance of tourist visas to women who are believed to be trying to enter the United States for the purpose of giving birth to a US citizen. The rationale for the rule is that it is an attempt to deter "birth tourism". If the Consular Officer at the post where the visa application has been made "has reason to believe" the foreign national is attempting to enter the US for this purpose, the officer shall deny the visa application. Women applying for a B-2/Visitor Visa should be prepared to be asked if they are pregnant or if they plan to become pregnant. The decision to deny the visa will be considered to be a "rebuttable presumption", however, as this is a new regulation, it is difficult to know how long an appeal process would take.
